TERMS AND CONDITIONS
WEBSITE SURVEY 2023 DRAW
(“Draw”)
By entering the Draw, each Entrant (as defined below) (and where applicable the Entrant’s parent or legal guardian) unconditionally accepts and agrees to comply with these terms and conditions (“Rules”), and agrees to be bound by the decisions of the Promoter in respect of the interpretation of these Rules and otherwise in relation to the Draw. Entrants who do not comply with the Rules will not be eligible to win the Prize (as defined below).

- Eligibility Requirements
The Draw is open to individuals who are residents of the United Kingdom and who are aged 18 years old and above (the “Entrants”). Entrants under the age of eighteen (18) must obtain their parent or legal guardian’s permission prior to entering the Draw.
Entrants can enter the Draw until 15/02/2023 23.45pm (the “Draw Period”).
Only one Entry per person.

No purchase is necessary to take part in this Draw.
Entrants may enter the Draw by:
- Completing the Website Survey here https://www.surveymonkey.co.uk/r/fbm_websitesurvey23 (“Survey”);
- Providing their contact details as required on the Survey including: Name, Email Address.

No other forms of entry will be accepted.
After the conclusion of the Draw Period, four winners of the Draw (“Draw Winner(s)”) will be selected by selecting at random an Entry from all valid complete Entries.
Filmbankmedia’s decision concerning the determination of the Draw Winner(s) and all matters relating to the Draw will be final and binding.
- Prizes
4 (four) Draw Winners shall receive each one (1) Amazon voucher to the value of £25 (the “Prize”).
- Notifying the Draw Winners
The Draw Winners will be informed by email by the Promoter within five (5) working days after 15/02/2023. The Draw Winner(s) will be required to confirm acceptance of their Prize within 5 (five) working days after receipt of notification of the Prize (“Confirmatory Message”). The Draw Winner(s) must provide their full name, address, and mailing address in the Confirmatory Message. The Promoter will inform the Draw Winner(s) of any arrangements for the redemption of the Prize.
- Winner(s)’ List
Where required by local law, the name of the Draw Winner(s) may be available upon request. Please send a self-addressed stamped envelope to: Website Survey Draw, Filmbank Distributors Limited, Warner House, 1st Floor, 67-74 Saffron Hill, London, EC1N 8QX within one (1) month of the Draw closing date.
- Promoter
The Draw is organised by Filmbank Distributors Limited (the “Promoter” or “Filmbankmedia”).
In order to administer the Draw, the Promoter may make use of advertising and promotional agencies (“Filmbankmedia Agents”).
- Prize Terms
7.1 Prizes are subject to availability. The Promoter takes reasonable care to ensure that the Prizes are as described in these Rules. However, events may occur that make the awarding of the Prize impractical or inappropriate due to unforeseen circumstances or reasons beyond the control of the Promoter or Filmbankmedia In this situation, the Promoter may vary or amend the Prize to provide a reasonable alternative as a result of which the Promoter or parties connected to the Promoter shall not be held liable.
7.2 No cash or credit alternative is available and the Prizes are not transferable. Eligibility for the Prize may be subject to signing Filmbankmedia’s Prize Acceptance Form (available on request).
7.3 The Prize does not include anything not mentioned in these Rules.
7.4 Where applicable, the Draw Winner(s) and/or the parents or legal guardians of the Draw Winner(s) will be required to sign a Prize Acceptance Form within seven (7) days of the date of issuance. If the Prize Acceptance Form is not returned within the specified time period, the Prizes will be forfeited.
7.5 If a Draw Winner does not confirm acceptance of the Prize within the required time period, he/she will automatically forgo their right to claim the Prize and a runner up will be selected as an alternative Draw Winner. If such runner up also fails to accept the Prize in the required manner, the next runner up will be selected as an alternative Draw Winner and so on until another Draw Winner is chosen and has duly accepted in accordance with these Rules.
- Changes to the Rules
Subject to applicable law, the Promoter reserves the right to modify the Rules at any time without notice to Entrants. In such circumstances, updated Rules will be uploaded to and published on the Website.
For all that relates to the use of the Website, it is reminded that the Filmbankmedia Privacy Policy https://www.filmbankmedia.com/privacy-notice/ and the Terms and Conditions of Use https://www.filmbankmedia.com/website-terms-of-use/ accessible on or via the Website are applicable. The Rules shall prevail over any inconsistent provision contained in the Terms and Conditions of Use or the Privacy Policy posted on or via the Website.
9. Eligibility of Entries
9.1 Ineligible or fraudulent Entries are void. All Entrants will be deemed to have authorised the Promoter and Filmbankmedia Agents to check the completeness and accuracy of the information they supply for purposes of participation. An Entrant who has supplied incomplete, inaccurate or fraudulent information will be automatically disqualified. Any Entry that uses offensive or inappropriate language will automatically be disqualified.
9.2 Where the Draw entry mechanism involves public voting, Filmbankmedia reserves the right to disqualify any Entrant to the extent permitted by applicable law, if in Filmbankmedia’s sole discretion, the Entrant is considered to have manipulated or influenced the Draw outcome through fraudulent or dishonest means including, but not limited to, automated means and vote exchange forums or groups.
9.3 The Promoter and Filmbankmedia Agents are not responsible for lost, late, or misdirected Entries, for technical, hardware or software failures of any kind, for lost or unavailable network connections, or for failed, incomplete, garbled or delayed computer transmissions or any human error which may occur in the receipt or processing of the Entries.
9.4 Proof of entering information on the Website does not constitute proof of delivery or receipt of such information. Filmbankmedia is not responsible for the failure of any email or Entry to be received by it on account of technical problems or congestion on the internet or at any website.
9.5 Use of computer programs and other automatic means to enter the Draw is prohibited and may result in the disqualification of the Entrant.
9.6 The Draw is not open to employees or contractors of the Promoter or Filmbankmedia Agents, including each of their affiliates, subsidiaries, divisions, or Facebook, or Twitter, or any person directly or indirectly involved in the organisation or running of the Draw or their direct family members.
9.7 In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the e-mail account is registered on the date the Entry is submitted. All Entries become property of the Promoters and will not be returned.
9.8 Entries shall not be returned to Entrants.
10. Use of Personal Data
10.1 In order to participate in the Draw, Filmbankmedia requires Entrants to provide certain information about themselves on the Website, such as Entrant’s name, contact details and organisation. Some Entries may require the submission of user generated content (such as, pictures, videos, etc.), which may contain personal data. Filmbankmedia has specified which information is mandatory in order to participate in the Draw.
10.2 Submitted information will be used by Filmbankmedia to administer the Draw, which is in Filmbankmedia’s legitimate interest. Entry information will usually be kept until the Draw is fully administered, but in any event, no longer than six (6) months.
10.3 Filmbankmedia may require Draw Winner(s) to provide additional information in order to fulfil the Prize. This information may be shared with Filmbankmedia’s partners involved in the fulfilment of the Prize, e.g. prize providers.
10.4 Filmbankmedia may use cookies and other similar technologies to keep track of your interactions on the Website, and offer you a more personalised experience. As not all Website(s) are owned or operated by Filmbankmedia please see any third party privacy policies made available on the Website.
10.5 You have a right to access your personal data; to request that it be updated, deleted and/or restricted; and object to its processing upon legitimate grounds by contacting marketing@filmbankmedia.com. You also have a right to lodge a complaint with your local data protection authority.
11. Limitation of Liability
11.1 The Promoter and Filmbankmedia Agents do not accept any responsibility for any occurrences resulting from the Entrants’ connection to the internet via the Website and/or resulting from participation in the Draw. In particular, the Promoter and Filmbankmedia Agents do not accept responsibility for any damage or loss caused in any way to Entrants, their computer equipment and/or to data which is stored on any such equipment, or to their personal, professional or commercial activities.
11.2 If, for any reason, the Draw is not capable of running as planned, including infection due to computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure, human error or any other causes beyond the control of Filmbankmedia that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Draw, Filmbankmedia reserves the right to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend the Draw and let the Promoter select the Draw Winner(s) from all eligible Entries received prior to the cancellation or termination of the Draw.
11.3 In the event of unforeseen circumstances, the Promoter reserves the right to substitute any or all parts of the Draw. In this event, such a change will be publicised on the Website and any necessary amendments to these conditions will be made.
11.4 Entrants agree to the fullest extent allowed by applicable law to release and forever discharge Filmbankmedia, and its parent corporations, subsidiaries, assigns and employees, and any entity or person connected with the Draw from and against any and all claims, demands, losses and liabilities of any nature whatsoever which may now or hereafter arise, including but not limited to any loss of enjoyment, costs, delays or other harm or loss of any nature whatsoever caused by, contributed to, or arising out of or in connection with the Prizes.
11.5 If any court or competent authority decides that any of the provisions of these Rules are invalid, unlawful or unenforceable to any extent, the Rule will, to that extent only, be severed from the remaining Rules, which will continue to be valid to the fullest extent permitted by law.
11.6 Any attempt by an Entrant to deliberately damage the Website or to undermine the legitimate operations of the Draw may be a violation of criminal and civil laws and should any such attempt be made, the Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law.
11.7 The Promoter reserves the right to change, suspend or cancel the Draw without specifying the reasons for its decision and without incurring liability as a result. These Rules will apply to the Draw. The Promoter reserves the right to modify these Rules at any time prior to, during or after the Draw Period.
11.8 Filmbankmedia does not exclude any liability for death or personal injury arising as a result of Filmbankmedia’s negligence in respect of the Entrants’ use of the Website.
11.9 By entering the Draw, Entrants agree to release any social networking site that the Draw may be accessed through from any and all liability connected with the Draw.
11.10 If applicable law does not allow all or any part of the above limitation of liability to apply, the limitations will apply only to the extent permitted by applicable law.
11.11 The Drawn is governed by the laws of your country of residence. You hereby consent and submit to the exclusive jurisdiction of the courts of your country of residence for any action however so arising out of these Rules.
